2. Description of Services
Lenscatcher operates a mail-order webshop for the sale of contact lenses, medical optics, care products and cosmetics with corresponding accessories.

3. Conclusion of the Contract
The contract is concluded, with due regard to the standard terms and conditions, by clicking on the order button. As a rule, our receipt of the order is confirmed in writing via e-mail. By concluding the contract you confirm that you will only place a repeat order for contact lenses that have been fitted properly by a contact lens specialist (ophthalmologist or optician) or well tolerated without exception. A first fitting or own fitting of contact lenses via the mail-order webshop is not possible. Moreover, by your order you confirm that you are at least 18 years old and undergo regular checks at your contact lens specialists (at least half-yearly). The contact lenses must be cleaned and looked after in accordance with the instructions of your ophthalmologist or optician and the product information. The recommended wearing times and information on durability must be observed strictly. In the event of eye irritations, other irritations, sight deterioration or redness etc., the contact lenses must be removed and an ophthalmologist be consulted. Please do not use defective or damaged contact lenses.

4. Prices
The prices and services marked on the website plus the flat rate shipping cost staggered according to product and delivery area (see FAQ shipping costs). Deviations or agreed additional services of the shipping costs are possible in the individual case, depending on the product and the delivery area. All prices are quoted for EU counties as inclusive of statutory VAT. In the case of deliveries in non-EU countries, VAT of currently 19% shall cease to apply and shall be deducted when issuing a bill. Any customs charges incurred when importing to non-EU countries shall be borne by the Customer. The staggered prices marked shall relate to contact lens packaging of the same parameter and colour. Prices shall be subject to alteration without notice. 

5. Payment Conditions / Delivery
Payment shall be made per credit card payment after the conclusion of the contract, plus the flat rate shipping cost and flat rate packaging cost for the respective product and delivery area. A return fee of currently 8.00 euros shall be charged for rejected bank debit vouchers that are not attributable to fault of our own. The Customer must convince him/herself of the proper condition of the goods. If this is not the case, the customer must refuse to receive the goods and notify this to the deliverer and Lenscatcher promptly. Lenscatcher shall only be liable for damage in case of intact packaging. The delivery time shall, as a rule, be 1-3 weeks, depending on the manufacturer and product. A delivery date can in principle not be guaranteed, since Lenscatcher has no influence on delays in delivery by the manufacturer and/or the shipping partners or force majeure. Delays in delivery shall therefore not be a ground for rescission. Return shipments that could not be delivered, where no fault of our own exists, can only be delivered again if the shipping costs incurred again are settled. The goods shall remain the property of Lenscatcher until such time as they have been paid for in the full amount.

6. Right to Exchange / Right to Return Goods
We grant in principle a legal right to return and exchange goods within 14 days after the receipt of the goods. As documentary evidence of this, the date of the postmark shall apply. This shall apply to return shipments in intact, unlabelled original packaging suitable for resale. Opened contact lens containers / boxes or packaging, all disposable lenses in soft secondary packaging (so-called blisters), since these are not suitable for resale according to the German Medical Products Act, as well as coloured contact lenses and special designs (e.g. toric lenses, multifocal lenses etc.), apart from in the case of defective or faulty goods, shall be excluded from the exchange or return. The sufficiently prepaid return shipment should be sent strictly with a small cover letter and a copy of the voucher for billing to the address indicated below. To enforce any claim for damages efficiently against the respective manufacturer, we ask the customer to send in the products objected to. As a rule, a credit entry is made by return remittance. To reimburse you, we therefore require your banking details (banking institute, IBAN, BIC/Swift-Code). In the event of damaged shipments, the receipt of the goods must be refused and notified promptly to the respective deliverer and Lenscatcher.

7. Liability and Claims for Damages
The customer shall indemnify Lenscatcher against any liability for health damage that was possibly caused by wearing the contact lenses or by using care products, cosmetics and accessories. The customer affirms that it will only place a repeat order for contact lenses via the mail-order webshop that have been that have been or fitted properly by a contact lens specialist (ophthalmologist or optician) or well tolerated without exception. Claims for damage that can be caused by an improper own fitting shall not be asserted. Furthermore, regular checks by a contact lens specialist shall be taken for granted. Claims for damages shall be restricted to the amount of the order value. Despite checks of their content, we assume no liability for the contents of external links. For the content and the updating of linked pages and / or pages of affiliated partners, their operators shall be exclusively responsible.

8. Data Protection
The customer data shall be used exclusively for the proper handling of the order or repeat order. The personal data may be used for internal advertising purposes / infomails. Deletions of the saved customer data or cancellation of the infomails can be carried out at any time via the customer login access or in writing. The passing on of data to third parties, apart from for the settlement of the payment transaction is not provided. The data transmission shall take place for your security via a secure SSL connection (secure sockets layer).

9. Copyright
Lenscatcher is a protected trademark. All contents on the website of Lenscatcher are protected by copyright; the texts, the design, in particular the graphics are subject to the exclusive licence of Lenscatcher. The reproduction of our page is only permitted for the purpose of establishing business contact or getting in contact with the company Lenscatcher. Copies, even in a modified form, in particular in the case of photographic and film material are not permitted without written permission from the company Lenscatcher. All rights reserved. The photographic and film material is to some extent subject to the copyright of the manufacturers.

10. Product Illustrations / Product Information / FAQ
The product illustrations may deviate from the appearance of the delivered products in the individual case. We shall make every effort, however, to update the illustrations as far as possible. The product information shall be details given by the manufacturer. We assume no liability for the information made available. Mistakes and printing errors reserved.

11. Effectiveness
Should individual provisions of these Standard Terms and Conditions be ineffective, this shall not affect the effectiveness of the Standard Terms and Conditions in other respects. We assume no liability for printing errors. Right of modification reserved.

12. Place of Jurisdiction
The place of jurisdiction shall, as far as legally permissible, be Vechta/Germany. The place of performance shall be the registered office of the company. For all legal relations between us and the party ordering, the law of the Federal Republic of Germany shall apply to the exclusion of the Vienna Convention on the International Sale of Goods 1980 (CISG), even if the party ordering has its registered office abroad. The language of the court shall be German.
